As the first deadlines under Regulation (EU) 2025/40 on packaging and packaging waste (PPWR) approach, with the rules set to apply from August 12, the European Commission today published guidance to support implementation of the new legislation and clarify its most controversial aspects, since, as stated in the accompanying note, “the practical implementation of the new rules has generated numerous questions due to their novelty and complexity”.
The guidance document is still in draft form and will be translated into all EU official languages before being formally adopted. It is intended to clarify those aspects of the regulation that require further interpretation, as well as the points on which companies and other stakeholders have requested support, starting with the basics: which actors fall within its scope as producers or manufacturers, and which items are considered packaging under the PPWR, including specific cases such as flower pots, garment bags and medical devices.
The document also further defines the restrictions applicable to single-use packaging, PFAS (per- and polyfluoroalkyl substances) in food-contact packaging, and the implementation of reuse targets. It also provides guidance on how to apply extended producer responsibility (EPR) for packaging and on the obligation to set up deposit and return systems.
Lastly, it outlines the degree of flexibility granted to Member States with regard to compostable packaging.
The guidelines are complemented by a section of frequently asked questions (FAQs) addressing practical issues raised by the value chain following adoption of the Regulation. These questions and answers will be updated in the coming months in line with requests from operators.
The Commission points out that, while the guidance document and the FAQs provide greater clarity on the key provisions of the new packaging rules, they do not replace, supplement or amend the provisions of the PPWR.
Several delegated and implementing acts are also being prepared, including those concerning harmonised registration and reporting formats for extended producer responsibility, labelling for the correct sorting of waste by consumers, recycled content in plastic packaging and recyclability criteria.
